In Labour Law Association v. Union of India 2023 LiveLaw (SC) 536, the Supreme Court directed the Union Government to complete the process of filling the vacant seats of the Central Government Industrial Tribunals (CGIT) with judicial officers before August 31, 2023. The direction was issued by a bench comprising CJI DY Chandrachud, Justice PS Narasimha and Justice Manoj Misra.
The petitioner in the case, Labour Law Association, had earlier informed the SC that nine of the Central Government Industrial Tribunals’ twenty-two benches were empty, and three more were to soon fall empty in 2023. To remedy this situation, the top court had earlier directed for a Search-cum-Selection Committee (SCSC) to be constituted. Accordingly, an SCSC, chaired by a Judge of the SC nominated by the Chief Justice of India was formed by the Ministry of Labour and Employment on March 6, 2023.
Additional Solicitor General Balbir Singh informed the court that the SCSC had carried out the selection process and nine recommendations had been made till June 26-27, 2023. He further added that the Union government had carried out the next process for giving effect to the appointments in line with the recommendations made by the SCSC.
Accordingly, the SC, in the present case, mentioned that it was anticipated that the entire process would be completed within four weeks. Thus, it directed the Union government to complete the same and notify the appointments, the deadline for which is August 31, 2023.
