The Governor of West Bengal has urged all employers and employees within the state governed by the Payment of Bonus Act 1965 to adhere to the guidelines issued by the West Bengal state government when determining the rightful entitlements of workers regarding bonus payments, particularly in anticipation of the upcoming Durga Puja festivities for the year 2023. The guidelines state that: the employers must adopt a flexible attitude while deciding on the issue of bonus payments under the payment of Bonus (Amendment) Act 2015; All the payments paid by the establishments in the form of bonus this year should not be less than that of the preceding year; all employees who have worked for more than 30 days, irrespective of being in casual employment or re-employed or employed through contractors, shall be entitled to the bonus.
The government also appealed to all the employers, through the notified guidelines, who have defaulted the payment of bonus in the previous year to clear all the dues this year along with the payment of bonus for the current year. The persons employed in the unorganized sectors though not covered by the Payment of Bonus Act 1965, shall also be entitled to the bonus. The government expects all payments of bonus to be completed October 6, 2023 i.e., before the commencement of the Durga Puja. All the trade unions and employers’ organizations are expected to cooperate to help in maintaining industrial peace and settle bonus-related disputes without disrupting work.
