A draft of the Ladakh Rights of Persons with Disabilities Rules, 2023 has been released by the Department of Social & Tribal Welfare, Ladakh. The proposed rules seek to provide certain rights and entitlements to the persons with disabilities to prevent any sort of discrimination in both the government and private establishments by mandating the head of such an establishment to act promptly upon receiving any complaint from an aggrieved persons regarding discrimination on the ground of disability.
The rules also propose the creation of a committee for research on Disability at the Union territory level which shall consist of representatives from the Health Department, a member working in the field of Disability under the administration of UT Ladakh, Director of social welfare, etc. It also creates a provision for the appointment of a limited guardian who may aid the person with disability by taking legally binding decisions on his behalf after consulting the latter. Apart from this, the draft rules also mandate every establishment to publish an equal opportunity policy for persons with disabilities so that they have an equal employment opportunities and job vacancies. The said rules also lay down the procedure for application of certificate of disability, its issuance procedure, validity and the grievance mechanism related to this issue. After thirty days from the date the public copies of the gazette announcement are made available, it will be taken into consideration.
