The State Government of Karnataka, in the exercise of the powers conferred by sub-sections (1) and (2) of section 62 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, has amended the Building and Other Construction Workers’ (Regulation of Employment and Conditions of Service) (Karnataka) Rules, 2006. In total, the amendment has been brought in six aspects of the 2006 Rules. For instance, clause (j) rule 2 of the 2006 rules has been amended and the revised definition of “Competent Person” is a person who possesses the necessary qualifications and experience to test and certify lifting appliances, gears, wire ropes, pressure plant, or equipment.
It has also inserted a new rule, rule 54A, which mandates every individual or institution willing to register or be recognised as a competent person to submit an application in Form no. XXIV-A or XXIV-B (given in the notification). It outlines a detailed criteria for recognition of competent persons which includes the minimum qualification required, experience for the purpose and the facilities at the individual’s command. Other than this, it has brought amendments to rule 225, rule 331 and has inserted new forms: Form XXIV-A: application form for the grant of certificate of competency to a person; Form XXIV-B: application form for the grant of certificate of competency to an institution; Form XXIV-C: form of certificate of competency issued to a person or an institution; Form XXIV- D: report of examination of pressure plant or equipment.
